We have all heard by now the fight that 95.5 WTVY has taken on for the Border Patrol Agents. What a lot of us did not know is that this is not the first incident. Edwards County Deputy Sherriff Gilmer Hernandez was indicted for an offense that basically read that an illegal was deprived of her rights protected by our Constitution. Hernandez is presently being held in Del Rio, Texas until his sentencing on March 12. Yes, we will join in this fight too. Notice to Alabama Constituents Concerned with the Conviction of Border Patrol Agents Ramos and Compean
What Alabama Constituents Should Know About Pardons:
The power to pardon the two border agents who have been convicted of federal crimes, or to commute their sentence (reduce the amount of time they must serve) is vested in the President alone. This is called "the clemency power."
According to standard Department of Justice (DOJ) procedures, a person may not apply for a full pardon until at least five years after his or her release from prison. Since the border agents have just begun to serve their sentence, DOJ regulations would prevent them from being eligible for a full pardon, according to the Department's standard process for reviewing pardon requests. This is a discretionary process, however, and as expressly guaranteed by the Constitution, the President has authority to grant pardons at any time he sees fit, regardless of time served, although that has rarely been done outside the Department of Justice pardon process.
The President also has the ability to immediately commute, or reduce, their sentences. When deciding whether to reduce a sentence, the President takes into consideration the amount of time served. The chance that a sentence reduction request will be granted increases as more time is served.
According to the Department of Justice Website, "...commutation requests are generally not accepted from a person who is currently challenging his or her conviction or sentence through appeal..." Since the border patrol agents plan on appealing their conviction, the regular DOJ process must be waived if their sentences are to be commuted before their appeals are over.
What Alabama Constituents Can Do:
Constituents who want to help the border patrol agents can:
Write the President's Pardon Attorney to express public support for a Presidential pardon and/or reduction in sentences the border patrol agents are currently scheduled to serve. Specifically, they should ask that the regular process of waiting until appeals are exhausted be waived and that the President commute or reduce the sentences of the border patrol agents immediately.
Write Attorney General Gonzales and ask that he instruct the prosecutor to reconsider the charges and the severity of the sentence. Specifically, they should ask that the agents be offered a lower sentence as part of settling the appeal.
